‘The Situation’ Denied Trademark

Jersey Shore’s The Situation has a legal situation on his hands.

Like Snooki before him, Mike “The Situation” Sorrentino’s application to trademark his ab-inspired nickname was rejected by the U.S. Patent and Trademark Office (USPTO,) according to The Smoking Gun. Evidently “The Situation” name is too similar to a “Situation” trademark granted last year to a Memphis retailer selling women and children’s apparel.

The rejection is a blow to The Sitch’s plan to sell t-shirts and, ahem, underwear bearing his preferred name. According to documents obtained by The Smoking Gun, The Sitch’s attorney argued there would be no confusion between his trademark and the one given to the probably less hard-bodied Memphis retailer, saying Sorrentino is obviously not operating a clothing store, but expanding his “well known persona and fame.”

Fans may recall Snooki suffered a similar fate last month, when her trademark application was thwarted by an orange cartoon cat named Snookie.
