Lindsay Lohan Sent Back to Rehab, Avoids Jail
UPDATE: Lindsay Lohan will not serve jailtime for her failed drug test in September. The Mean Girls actress will serve in inpatient rehab until January 3, 2011.
According to reports, Lohan cried while read a hand-written letter to Judge Elden Fox, and later said "thank you" when the judge ordered her to rehab instead of jail. TMZ reports that the probation department requested jail for Lohan, but Fox believed rehab would be a better fit.
Lindsay was due in court for violating her probation after she failed two drug tests just a few weeks after being released from court-ordered inpatient rehab. She arrived to court bearing a glowing smile.
In a Twitter message to fans, Lindsay confirmed that she had failed the drug test. "Substance abuse is a disease, which unfortunately doesn't go away overnight," Lindsay tweeted, "I am taking responsibility for my actions and I'm prepared to face the consequences."
Linday reportedly tested positive for both cocaine and amphetamines. It wasn't immediately clear if the amphetamines were from Adderall, which Lindsay is legally prescribed by a physician. If the amphetamines were from Adderall, the starlet may not face charges for that failed drug test.
On September 20 a warrant was issued for Lindsay's arrest after Judge Elden Fox was notified of her failed drug test. Lindsay appeared before the court on September 24 and was hauled off to jail. However, less than 24 hours later, the starlet posted bail and was released from custody. Lindsay immediately checked into the Betty Ford Clinic after being released from jail.
Lindsay was sentenced to 90 days in jail and 90 days in inpatient rehab on July 6. The jail sentence came after Lindsay was convicted of violating the terms of her probation stemming from a 2007 DUI conviction.
The trouble starlet went to jail on July 20 but was released on August 2 after serving on 12 days of her 90-day sentence. After being released from jail, Lindsay was immediately taken to rehab at the UCLA Medical Center where she began her 90-day inpatient rehab sentence. However, Lindsay was released from the rehab center–with the blessing of her doctors at UCLA–after she served only 22 days. She continued outpatient rehab treatment and daily drug testing.
As previously reported, Lindsay left the Betty Ford Clinic on Thursday night to prepare for today's court appearance. The starlet is hoping to avoid jail and stick to her current rehab program. Insiders think that Lindsay will likely do time but it all comes down to Judge Fox's decision.
