Gabriel Aubry 'Highly Unlikely' to Face Criminal Charges; Olivier Martinez Emerges With Hand Brace After Thanksgiving Brawl
Gabriel Aubry, the ex-boyfriend of actress Halle Berry, is "highly unlikely" to face criminal charges after he was booked for misdemeanor battery following a violent altercation with Berry's fiance, Olivier Martinez, on Thanksgiving.
Law enforcement sources tell TMZ that Aubry, 37, should manage to avoid more legal woes as most believe the Nov. 22 brawl was "mutual combat."
Aubry was previously in court on Tuesday to ask a judge to lift an emergency protection order placed against him by Berry, which states he cannot come within 100 yards of the Oscar-winning actress, their four-year-old daughter, Nahla, and Martinez.
The request was ultimately denied.
Meanwhile, Martinez was placed at the Cedars Sinai Medical Centre in Los Angeles on Tuesday, where he was spotted emerging with a brace on his right hand.
The sighting comes shortly after photos were released of Aubry's face following the brawl, which was severely bruised and battered.
The judge denied Berry's request in November.
