TMZ reported earlier this week that Berry was set to seek a restraining order against Aubry.emergency order of protection issued to her last week after Aubry got into a bloody fight with Berry’s fiance, Olivier Martinez, on Thanksgiving day.
The protection, which ordered Aubry to stay 100 yards away from Berry, the couple’s four-year-old daughter, Nahla, and Martinez, expires Tuesday.
Aubry, 37, was arrested last Thursday and charged with misdemeanor battery following a heated argument inside Berry’s home. Aubry, who is due back in court on Dec. 13, was released on $20,000 bail.
Both Aubry and Berry's lawyers were not available for comment at press time.
