Halle Berry’s Ex Gabriel Aubry Won’t Be Prosecuted in Thanksgiving Brawl Case (REPORT)

Halle Berry’s ex Gabriel Aubry won’t be charged with a crime after he was arrested and charged with misdemeanor battery for fighting with Berry’s fiance Olivier Martinez on Thanksgiving morning, sources tell TMZ.

The reason: Berry and Martinez feel it would not be in the best interest of Berry and Aubry’s four-year-old daughter, Nahla.

Instead, Aubry is expected to agree to anger management courses, though there is a chance that the case — which is due for an informal hearing at the city attorney’s office in Los Angeles — may be dropped altogether.

This comes just days after Berry and Aubry reached an agreement in their long-gestating custody battle over Nahla.

“The parties have reached an amicable agreement. There will be no further statements regarding this matter,” an attorney for Berry told reporters on Friday.

For months, Berry had tried to move Nahla to Martinez’s home country of France to protect her from the paparazzi. A judge denied her request in November.

Aubry, 37, was arrested on Thanksgiving and charged with misdemeanor battery following a heated argument inside Berry’s home. The argument, which detectives have concluded was instigated by Aubry, left visible injuries on both Aubry and Martinez.

Berry subsequently obtained an emergency protection order against Aubry, which said he could not come within 100 yards of Berry, Nahla or Martinez.
