The Oscar winning actress was arrested on a disorderly conduct charge while her husband was charged with a DUI. The couple spent a brief time in jail before being released on bond.
Witherspoon, 37, has been in the Peach State filming her new movie The Good Lie.
According to a police report obtained by Variety, the arrest was made after Toth, 42, was pulled over for irregular driving behavior. The report claims that he later blew a .139 on a Breathalyzer test.

The report also includes details on how Witherspoon played the Hollywood card after she refused to stay in the vehicle, told the officer that she was a US citizen and that she was allowed “to stand on American ground.”
“Mrs. Witherspoon asked, ‘Do you know my name?’ I answered, ‘No, I don’t need to know your name.’ I then added, ‘right now.’ Mrs. Witherspoon stated, ‘You’re about to find out who I am,’” according to the officer’s report. [via. Variety]
Sources tell Variety that a court appearance in Atlanta Municipal court is scheduled for Monday morning, but the couple is not expected to appear.
Witherspoon and Toth were married in March 2011 after dating for more than one year. In September 2012, the actress gave birth to the couple’s first child, a son named Tennessee. Witherspoon also has two children from her previous marriage to Ryan Phillippe.
In 2005, Witherspoon, a New Orleans native, took home the Academy Award for Best Actress for her portrayal of June Carter Cash in Walk The Line.
On Sunday, the couple made their first post-arrest appearance at the 2013 Tribeca Film Festival in New York City for the premiere of her new film Mud.
[UPDATE at 11PM PT]: Witherspoon has since released a statement regarding her arrest.
“Out of respect for the ongoing legal situation, I cannot comment on everything that is being reported right now. But I do want to say, I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that is no excuse. I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I’m very sorry for my behavior.”
