Kendall, Kylie Jenner, and PacSun Receive Lawsuit Over Trademarked Phrase on Clothing
Imitation is the sincerest form of flattery.
Kendall, Kylie Jenner, and fashion retailer PacSun have been sued by Island Company, a resort lifestyle retailer in West Palm Beach, Florida, over a phrase that the Jenners used on their apparel for the surf-chic brand. Island claims that the sisters recycled their phrase, “Quit your job. Buy a ticket. Get a tan. Fall in love. Never return.” on a shirt that reads “Run away. Fall in love. Never return.”
According to PageSix, Island claims that their rendering of the phrase “is likely to cause confusion, mistake and deception among consumers, the public and the trade as to whether defendants’ products or services are affiliated with, sponsored by or endorsed by plaintiff.”
The retailer, who has used the trademark phrase since 2005, ask that PacSun and the Jenners remove the apparel in question from their clothing line.
