Will Donald Trump Sue NBC over the Leaked ‘Access Hollywood’ Tape?

In an interview with Bill O’Reilly for Fox News, Republican presidential candidate Donald Trump discussed the possibility of taking legal action against NBC after video of his lewd conversation with Billy Bush surfaced.

Trump told O’Reilly said that the incident “was certainly illegal” during his O’Reilly Factor appearance Thursday night (Oct. 27, 2016), but did not specify whether he felt that the leak or the recording itself was unlawful. When asked if he plans on suing NBC, Trump responded, “You’ll see, you’re going to see after the election. We are going to find out soon enough, I will tell you.”

As Variety reports, California state law says that it is illegal to record a conversation without consent, only making an exception to cases “in which the parties to the communication may reasonably expect that the communication may be overheard or recorded.” The consent is unclear in Trump’s scenario with Bush, so let’s see if he can even attempt to take NBC by the whatever.
