Miley Cyrus' Lawyers Fire Back in Photo Lawsuit

Miley Cyrus may have  already apologized profusely for her seeming photo blunder earlier this year, but if the Hannah Montana star's legal team has its way, financial reparations won't be forthcoming.

E! Online reports that Cyrus' lawyers issued a challenge on Tuesday to a $4 billion class-action lawsuit filed against their client earlier this year, after a photo of Miley pulling her eyelids back with her fingers emerged on the Internet.

Southern California resident Lucie J. Kim filed the suit on behalf of Los Angeles County's entire Asian-Pacific Islander population, claiming that the photo was racially insensitive and financial damages are in order.

In their challenge, Cyrus' attorneys assert that Kim's suit is based on a civil-rights statute pertaining to equal access to public accommodations, and Cyrus' pocketbook doesn't count as such. Their filing says that Kim's lawsuit doesn't entitle her to "redress for racial insults."

Not that they're admitting that Cyrus was being racially insulting. The lawyers go on to state that their client "did not intend to discriminate against Asian-Pacific Islander descent."

After the photos were leaked, Cyrus attempted to quell the outrage by claiming that she was merely making "goofy" faces.

A hearing on the motion to dismiss the suit is scheduled for June 4.

    If everyone is suing Miley, then I think the American Dental Association has a pretty strong case against those gums of her.

    i think this is all ridiculous...the woman filing the lawsuit is assuming miley was making a "asian-insulting" gesture. there is no proof, let the girl be and make money the old fashion way...called a job

    im not saying its right in any way, but last time i checked racial discrimination is not illegal and there's no way miley should be sued for what she did. leave the girl alone

    i think its stupid that they want to sue her she was just making faces and plus there was an asian guy in the photo they were just being teens all teen do that kind of stuff plus theres alot of teen that do way worse then that its dumb shes just a teenager all teens make mistakes just because shes a cleb doesnt mean she can be treated diffrently then any other teen.

    really like, if any regular person took a picture like that, would you sue them $4 billion? no! just cause shes famous she has to pay $4billion? is thaat what you want people to thinkk?i dream of being an entertainor, but why should entertainers be charged in such harsh ways when they are innocent? also miley is still a minor, though she's has a job and such, she is still only six teen read the comments and just LEAVE HER ALONE!!!!
