Modern Family star Winter, 14, is currently being cared for by Gray, who has temporary custody of the teenager after abuse allegations were lodged against their mom.
The letter, which Celebuzz has obtained, states Hay’s claims are “false, defamatory, and as such, are actionable under California law.”
In her legal letter, Workman admits that she did send an e-mail to Hay containing photos of Shanelle with the intent of raising questions about her credibility as a guardian.
“It has come to our attention that false statements were made by Jonathan Hay,” according to the letter, written by her attorney Nick Pacheco.
“As the attached email sent to Mr. Hay shows Ms. Workman never represented to Mr. Hay that nude pictures existed of her daughter Shanelle. The attached e-mail contains pictures which raise questions, to Ms. Workman, whether Shanelle is a fit guardian of a teenager.
“The statements made by Jonathan Hay regarding Ms. Workman and leaking nude pictures are false, and defamatory, and as such are actionable under California law.”
The two photos sent to Hay show Shanelle wearing a sexy chain mail bikini type outfit while she attended a 2003 event known as “One Life to Live.”
Responding to Workman’s cease and desist letter, Hay released the following statement to Celebuzz:
“Chrystal Workman told me she wanted photos of Shanelle to be leaked before her deposition this past Tuesday. She told me her attorney wanted to show them in court, but only after they had been released publicly,” he said. “I have not talked to her attorney until today, after he sent the cease and desist late last night, so I can’t really say for a fact whether or not it is true that the he asked Chrystal to leak them.”
It is the latest bizarre twist in the story with Workman previously admitting that she sent Hay the risque images after she found them on the internet because she thought they showed her eldest daughter “lacked good judgement” and was “not a suitable role model” for Ariel.
Workman has claimed in the past that the family wants to reunited.
“We want to thank everyone for their thoughts and prayers,” Workman, along with her ex-husband Glenn Workman, said in a statement released after the ruling last month. “We feel that today was a small victory for our family. We are one step closer to reuniting with our daughter and we were both in court today to let her know we love her and will always be there for her.”
A source close to the family echoed these sentiments, telling Celebuzz that Winter’s mother is eager to reconnect with her.
“After trial [Nov. 20], Chrystal said she was very happy and hopeful and ready to start counseling with Ariel,” said the source. “The first thing Chrystal is going to do when she gets into counseling is tell Ariel that none of this matters and there are no ramifications of this whole ordeal”
“She just wants them to wipe the slate clean and move forward as a family.”
